Lubbock Renovations LLC

Effective Date: September 27, 2026

1. Introduction and Acceptance of Terms

These Terms of Service (\"Terms\") govern your use of the construction, renovation, remodeling, and related services (\"Services\") provided by Lubbock Renovations LLC (\"Company,\" \"we,\" \"us,\" or \"our\"). By requesting an estimate, signing a proposal or contract, or engaging us for Services, you (\"Client,\" \"you,\" or \"your\") agree to be bound by these Terms. If you do not agree to these Terms, please do not engage our Services.

These Terms apply to all communications, estimates, proposals, and work performed by the Company, in addition to any separate written contract or work order signed by the parties. In the event of a conflict between these Terms and a signed project contract, the signed contract will control for that project.

2. Estimates and Proposals

Estimates provided by the Company are based on the information and site conditions available at the time of inspection and are subject to change if actual conditions differ (e.g., hidden damage, code issues, or structural surprises discovered once work begins).
A written proposal or contract will outline the agreed scope of work, materials, timeline, and price before work begins.
Estimates are valid for 30 days from the date issued unless otherwise stated, after which prices may be adjusted due to changes in material or labor costs.

3. Scheduling and Performance of Work

Project start dates and completion timelines are estimates and may be affected by weather, material availability, permitting delays, inspections, subcontractor availability, or changes requested by the Client.
The Company will make reasonable efforts to communicate any changes to the schedule as soon as they become known.
The Client agrees to provide reasonable access to the property during agreed working hours for the duration of the project.

4. Change Orders

Any changes to the agreed scope of work, materials, or specifications requested after work has begun must be documented in a written change order signed by both parties before the additional work is performed. Change orders may affect the project price and timeline. Verbal requests for changes are not binding until confirmed in writing.

5. Payment Terms

Payment schedules (deposits, progress payments, and final payment) will be specified in the project contract or invoice.
Deposits, where required, secure scheduling and the purchase of materials and are non-refundable once materials have been ordered or work has been scheduled, except as otherwise agreed in writing.
Invoices are due upon receipt unless otherwise stated. Late payments may be subject to a late fee and may result in a pause of work until the account is brought current.
The Company reserves the right to place a mechanic's lien on the property in accordance with Texas law for unpaid amounts owed for labor or materials.

6. Client Responsibilities

Provide accurate information about the property, existing conditions, and any known hazards (e.g., asbestos, mold, structural issues).
Secure any necessary homeowners association (HOA) approvals prior to the start of work, unless the Company has agreed in writing to handle this.
Remove or protect personal property, furniture, and valuables from the work area unless otherwise agreed.
Ensure pets and household members are kept clear of active work areas for safety.

7. Permits and Code Compliance

The Company will obtain permits required for the scope of work as applicable and will perform work in accordance with applicable building codes and industry standards. The Client is responsible for any costs associated with bringing pre-existing, non-conforming conditions into compliance unless such work is included in the agreed scope.

8. Communications

Project updates, scheduling notices, invoices, and other communications may be sent via phone call, text message, or email using the contact information you provide to us.
By providing your phone number and email address, you consent to receive project-related communications, including automated or recurring messages regarding scheduling and invoicing, through these channels.
You may request a different preferred method of contact at any time by notifying us directly.
Standard message and data rates from your mobile carrier may apply to text communications.

9. Warranties

The Company warrants its workmanship against defects for a period of one (1) year from the date of project completion, subject to normal wear and tear and proper use and maintenance of the completed work.
Materials and products used in the project are covered by the manufacturer's warranty, where applicable, and the Company will assist in facilitating manufacturer warranty claims but does not independently warrant manufactured products beyond the manufacturer's terms.
This warranty does not cover damage caused by the Client, third parties, acts of nature, normal settling, or lack of maintenance.

10. Limitation of Liability

To the fullest extent permitted by law, the Company's total liability for any claim arising out of or related to the Services shall not exceed the total amount paid by the Client for the specific project giving rise to the claim. The Company shall not be liable for indirect, incidental, consequential, or special damages, including loss of use, loss of income, or costs of alternative accommodations, except where such limitation is prohibited by law.

11. Insurance

The Company maintains general liability insurance and, where applicable, workers' compensation coverage for its employees. Certificates of insurance are available upon request. The Client is encouraged to notify their homeowner's insurance carrier of planned renovation work as appropriate.

12. Site Safety and Existing Conditions

The Company will follow standard safety practices during the course of work. The Client acknowledges that renovation work may involve noise, dust, and temporary disruption to portions of the property. The Company is not responsible for pre-existing conditions not part of the agreed scope of work, including latent defects not reasonably discoverable prior to starting work.

13. Cancellation and Termination

Either party may terminate a project agreement with written notice as specified in the signed contract.
If the Client cancels after work has begun, the Client is responsible for payment for all work performed, materials purchased or ordered, and any restocking or cancellation fees incurred by the Company.
The Company reserves the right to pause or terminate work if the Client fails to make payments as agreed, fails to provide reasonable site access, or creates unsafe working conditions for our crew.

14. Dispute Resolution

The parties agree to attempt to resolve any dispute arising from these Terms or a project agreement through good-faith negotiation. If a resolution cannot be reached, the parties agree that any dispute will be resolved in the state or county courts located in Lubbock County, Texas, and that Texas law will govern these Terms, without regard to conflict of law principles.

15. Photographs and Marketing

The Company may take before-and-after photographs of completed projects for use in marketing, portfolio, and promotional materials. Photographs will not include identifying information about the Client's address or personal details without consent. Clients who prefer their project not be used for marketing purposes may opt out by notifying the Company in writing.

16. Changes to These Terms

The Company may update these Terms from time to time to reflect changes in our practices or legal requirements. The most current version will be made available upon request or posted on our website, if applicable, with an updated effective date. Continued engagement of our Services after changes are posted constitutes acceptance of the revised Terms.
